1. Acceptance of Terms
Welcome to testify.law, an expert witness marketplace platform operated by Dark Vector Systems LLC (“testify.law,” “we,” “us,” or “our”). By accessing or using the testify.law platform (the “Platform”), you agree to be bound by these Terms of Service (the “Terms”).
If you do not agree to these Terms, you may not use the Platform.

1.1 Age Requirement
You must be at least 18 years of age to create an account and use the Platform. By creating an account, you represent and warrant that you are at least 18 years old.
1.2 Agreement by Use
By creating an account, accessing the Platform, or using any of our services, you acknowledge that you have read, understood, and agree to be bound by these Terms, as well as our Privacy Policy.
2. Account Terms
2.1 Account Eligibility
To create an account on testify.law, you must:
- Be at least 18 years of age
- Provide accurate, current, and complete information during registration
- Maintain and promptly update your account information to keep it accurate and current
- Not have been previously suspended or removed from the Platform
2.2 Account Types
testify.law offers two types of user accounts:
Expert Accounts: For expert witnesses who wish to create public profiles to be discovered by attorneys. Expert accounts require a paid subscription (see Section 3 for pricing details).
Attorney Accounts: For attorneys seeking expert witnesses. Attorney accounts are free and do not require a subscription.
2.3 Account Security
You are responsible for:
- Maintaining the confidentiality of your account password
- All activities that occur under your account
- Notifying us immediately if you become aware of any unauthorized use of your account
testify.law will not be liable for any loss or damage arising from your failure to maintain account security.
2.4 Account Registration Requirements
When you register for an account, you agree to provide truthful and accurate information. For expert accounts, you represent and warrant that all credentials, licenses, certifications, education, and experience information you provide is accurate and current.
3. Subscription Pricing and Payment
3.1 Expert Subscription Tiers
Expert witness accounts require a paid subscription. As of February 4, 2026, the following subscription tiers are available:
- Basic: $29 per month
- Featured: $79 per month

3.2 Attorney Accounts
Attorney accounts are free. Attorneys are not charged to create an account, search for experts, or send inquiry messages through the Platform.
3.3 Founding Expert Trial
testify.law may offer a Founding Expert trial program with the following terms:
- Duration: 6-month free trial period
- Payment Information Required: You must provide valid payment information (credit card or other payment method) when signing up for the trial
- Auto-Conversion: At the end of the 6-month trial period, your account will automatically convert to a Basic subscription ($29/month) and your payment method will be charged
- Cancellation: You may cancel your trial subscription at any time before the trial period ends to avoid being charged. Cancellation can be done through your account settings or by contacting support@testify.law
- Notice: We will send you an email reminder before your trial converts to a paid subscription
3.4 Payment Processing
All payments are processed securely through Stripe, our third-party payment processor. By providing payment information, you agree to Stripe’s terms of service and privacy policy. See Stripe’s legal terms.
testify.law does not store your complete credit card number or financial account credentials. This information is securely handled by Stripe in accordance with PCI-DSS requirements.
3.5 Auto-Renewal
Subscriptions automatically renew at the end of each billing period (monthly or annually, depending on your selected plan) unless you cancel before the renewal date. You authorize us to charge your payment method for the renewal subscription fee.
3.6 Refund Policy
All subscription fees are non-refundable. We do not offer refunds or credits for partial months of service, upgrades, downgrades, or periods where you did not use your account. If you cancel your subscription, you will retain access to paid features until the end of your current billing period.
3.7 Price Changes
We reserve the right to change subscription prices at any time. Price changes will not affect your current billing period but will apply to subsequent renewals. We will notify you at least 30 days in advance of any price increase.
4. Credential Verification Disclaimer
IMPORTANT: WE DO NOT VERIFY CREDENTIALS
testify.law does NOT independently verify the credentials, licenses, certifications, education, experience, or qualifications of expert witnesses who create profiles on our Platform. Expert profiles contain self-reported information provided by the experts themselves.
Attorneys are solely responsible for:
- Verifying expert credentials before engagement
- Conducting due diligence on expert qualifications and background
- Confirming licenses and certifications are current and valid
- Evaluating expert suitability for specific cases
- Determining expert credibility and reliability
We provide the Platform as a tool for attorneys to discover expert witnesses, but we make no representations or warranties regarding the accuracy, completeness, or truthfulness of any information provided by experts. You acknowledge and agree that you use expert profile information at your own risk.
5. Platform Role and Intermediary Status
5.1 Intermediary Platform Only
testify.law is an intermediary platform that connects attorneys with expert witnesses. We do NOT:
- Provide legal services or legal advice
- Provide expert witness services
- Act as an agent, representative, or fiduciary for attorneys or experts
- Participate in negotiations between attorneys and experts
- Have any involvement in engagements, contracts, or agreements between attorneys and experts
5.2 Not a Party to Attorney-Expert Agreements
testify.law is not a party to any agreement, engagement, or transaction between attorneys and expert witnesses. All terms of engagement, including scope of work, compensation, timelines, deliverables, and other contractual terms, are solely between the attorney and the expert.
5.3 No Liability for User-to-User Transactions
We are not responsible or liable for:
- The quality, accuracy, or timeliness of expert services provided to attorneys
- Disputes between attorneys and experts
- Payment disputes or non-payment between parties
- Breaches of contract between attorneys and experts
- Professional malpractice or negligence by experts or attorneys
- Any damages arising from attorney-expert relationships formed through the Platform
5.4 Platform Purpose
Our role is limited to operating the Platform to facilitate discovery and communication. Attorneys and experts are independent parties who use the Platform to connect, but their professional relationships and obligations exist independently of testify.law.
6. User Content and Intellectual Property
6.1 Platform Ownership
testify.law owns all rights, title, and interest in the Platform, including our code, design, logos, trademarks, branding, and all intellectual property associated with the Platform. You may not copy, modify, distribute, sell, or lease any part of our Platform without our express written permission.
6.2 User Content Ownership
You retain ownership of all content you create and submit to the Platform, including your profile information, professional biographies, case history descriptions, and inquiry messages (“User Content”).
6.3 Limited License to testify.law
By submitting User Content to the Platform, you grant testify.law a non-exclusive, worldwide, royalty-free, sublicensable license to use, display, reproduce, and distribute your User Content for the purpose of operating and promoting the Platform. This license terminates when you delete your content or your account, except where content has been shared with other users (such as inquiry messages).
6.4 Inquiry Messages
Messages sent between attorneys and experts through the Platform are private communications between those parties. testify.law does not claim ownership of message content but retains the right to store and process messages as necessary to operate the Platform.
6.5 User Content Standards
You agree that your User Content will not:
- Contain false or misleading information
- Violate any third-party intellectual property rights
- Contain defamatory, harassing, or abusive content
- Include spam, promotional material unrelated to your professional services, or commercial solicitations
- Violate any applicable laws or regulations
6.6 Content Removal
We reserve the right to remove any User Content that violates these Terms or is otherwise objectionable, without prior notice.
7. Warranties and Disclaimers
7.1 No Warranties
THE TESTIFY.LAW PLATFORM IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.
7.2 No Warranty of Uninterrupted Service
WE DO NOT WARRANT THAT THE PLATFORM WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE, OR THAT DEFECTS WILL BE CORRECTED. WE DO NOT WARRANT THAT THE PLATFORM WILL MEET YOUR REQUIREMENTS OR EXPECTATIONS.
7.3 No Warranty on Expert Credentials
WE MAKE NO REPRESENTATIONS OR WARRANTIES REGARDING THE ACCURACY, COMPLETENESS, RELIABILITY, OR TRUTHFULNESS OF EXPERT CREDENTIALS, QUALIFICATIONS, EXPERIENCE, OR ANY OTHER INFORMATION PROVIDED BY USERS ON THE PLATFORM.
7.4 No Legal or Professional Advice
testify.law does not provide legal advice, expert witness services, or any professional services. Nothing on the Platform should be construed as legal, financial, or professional advice. You should consult with appropriate professionals for advice specific to your situation.
8. Limitation of Liability
8.1 Liability Cap
TO THE MAXIMUM EXTENT PERMITTED BY LAW, TESTIFY.LAW’S TOTAL LIABILITY TO YOU FOR ANY CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR YOUR USE OF THE PLATFORM SHALL NOT EXCEED THE GREATER OF:
- (A) The total amount of fees you paid to testify.law in the 12 months preceding the claim, or
- (B) $100 (for users who have not paid any fees, such as attorney accounts)
8.2 Exclusion of Consequential Damages
IN NO EVENT SHALL TESTIFY.LAW BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, LOSS OF DATA, LOSS OF BUSINESS OPPORTUNITIES, OR BUSINESS INTERRUPTION, ARISING OUT OF OR RELATING TO THESE TERMS OR YOUR USE OF THE PLATFORM, REGARDLESS OF THE THEORY OF LIABILITY (CONTRACT, TORT, STRICT LIABILITY, OR OTHERWISE) AND EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
8.3 Carve-Outs to Liability Limitations
The liability limitations in Sections 8.1 and 8.2 do NOT apply to:
- Claims arising from our willful misconduct or gross negligence
- Claims arising from fraud or fraudulent misrepresentation
- Death or personal injury caused by our negligence
- Any liability that cannot be limited or excluded under applicable law
8.4 Basis of the Bargain
You acknowledge and agree that the limitations of liability set forth in this Section 8 are fundamental elements of the agreement between you and testify.law, and that we would not be able to provide the Platform on an economically reasonable basis without these limitations.
9. Indemnification
You agree to indemnify, defend, and hold harmless testify.law, its officers, directors, employees, agents, affiliates, and service providers from and against any claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable attorneys’ fees) arising from or relating to:
- Your use of the Platform
- Your violation of these Terms
- Your User Content or any content you submit to the Platform
- Your violation of any third-party rights, including intellectual property rights or privacy rights
- Any engagements, agreements, or disputes between you and other Platform users (including attorney-expert relationships)
- Your violation of any applicable laws or regulations
testify.law reserves the right to assume the exclusive defense and control of any matter subject to indemnification by you, in which case you will cooperate with us in asserting any available defenses.
10. Termination and Account Deletion
10.1 Voluntary Termination
You may terminate your account at any time through your account settings. Upon voluntary termination:
- Your access to the Platform will cease immediately
- Your data will be deleted in accordance with our Privacy Policy
- You will not receive a refund for any unused portion of a prepaid subscription
10.2 Involuntary Termination
testify.law reserves the right to suspend or terminate your account immediately, without prior notice, if:
- You violate these Terms
- You engage in fraudulent activity or provide false information
- Your account is used for illegal purposes
- We are required to do so by law or legal process
- Continued provision of the Platform to you would create legal liability for us
No refund will be provided for accounts terminated for Terms violations.
10.3 Effect of Termination
Upon termination of your account (whether voluntary or involuntary):
- Your right to access and use the Platform immediately ceases
- Your profile and User Content will be removed from public display
- Your personal data will be handled in accordance with our Privacy Policy
- Inquiry messages previously sent to other users may remain accessible to those users
10.4 Surviving Provisions
The following sections survive termination of your account: Section 6 (User Content and Intellectual Property), Section 7 (Warranties and Disclaimers), Section 8 (Limitation of Liability), Section 9 (Indemnification), Section 11 (Dispute Resolution and Governing Law), and any other provisions that by their nature should survive.
11. Dispute Resolution and Governing Law
11.1 Governing Law
These Terms of Service are governed by the laws of the State of California, without regard to its conflict of law principles. You consent to the exclusive jurisdiction of the state and federal courts located in California for any disputes not subject to arbitration.
11.2 Binding Arbitration
Any dispute, claim, or controversy arising out of or relating to your use, payment, or provision of services through the testify.law Platform (each, a “Dispute”) shall be resolved by binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, rather than in court.
The arbitration will be conducted in California, or at another mutually agreeable location. The arbitrator’s decision will be final and binding, and judgment on the award may be entered in any court having jurisdiction.
11.3 Scope of Arbitration
This arbitration agreement applies only to Disputes arising out of or relating to your use, payment, or provision of services through testify.law or these Terms of Service. It does NOT apply to claims or disputes that are separate and apart from your use of the testify.law Platform or these Terms.
(This scope limitation complies with California Civil Code Section 1670.15, effective January 1, 2026, which limits arbitration in consumer use agreements to claims arising from the contract.)
11.4 Small Claims Court Exception
Either party may pursue a claim in small claims court instead of arbitration if the claim qualifies for small claims court jurisdiction and is brought in small claims court (and not removed or appealed to a court of general jurisdiction).
11.5 No Class Actions
YOU AND TESTIFY.LAW AGREE THAT DISPUTES WILL BE RESOLVED ON AN INDIVIDUAL BASIS. YOU WAIVE ANY RIGHT TO PARTICIPATE IN A CLASS ACTION LAWSUIT OR CLASS-WIDE ARBITRATION. The arbitrator may not consolidate more than one person’s claims and may not preside over any form of class or representative proceeding.
11.6 Arbitration Fees
Each party will be responsible for paying its own arbitration fees and costs in accordance with AAA rules. If the arbitrator finds that the substance of your claim or the relief sought is frivolous or brought for an improper purpose, the payment of arbitration fees will be governed by AAA rules.
12. Changes to Terms
We reserve the right to modify these Terms of Service at any time. When we make changes, we will:
- Update the “Last Updated” date at the top of these Terms
- For material changes: provide at least 30 days’ advance notice via email or through a prominent notice on the Platform
- For non-material changes: post the updated Terms on the Platform
Your continued use of the Platform after changes to these Terms become effective constitutes your acceptance of the updated Terms. If you do not agree to the updated Terms, you must stop using the Platform and may terminate your account.
